Patient-centeredness can be considered a popular, and at the same time “fuzzy”, concept. Scientists have proposed different definitions and models. The present article studies scientific publications that discuss the meaning of patient-centeredness to identify different “discourses” of patient-centeredness. Three discourses are presented; the first is labelled as “caring for patients”, the second as “empowering patients” and the third as “being responsive”. Each of these discourses has different things to say about the why of patient-centeredness; the patient’s identity; the role of (...) the healthcare professional; responsibilities for medical decision-making, and the role of health information. This article compares and contrasts the discourses in ways that allow us to see differences that matter for practitioners in healthcare. On the basis of a relational constructionist philosophy, it is argued that discursive diversity is both an inevitable and a potentially valuable aspect of conversations in healthcare. We are therefore invited to center the challenge of dealing with diversity in productive ways. This article ends with a discussion of the practical implications of the discourse analysis for projects that aim to make healthcare more patient-centered. Debates on patient-centered “Health Information Exchange” are used to explain the need for a recognition of different discourses of patient-centeredness and a reflexive stance towards them. (shrink)

This Handbook offers a broad yet unified treatment of many philosophical issues connected with climate change, ranging from foundational puzzles to detailed applications. It extends to many branches of philosophy that are relevant to the understanding of the premises and implications of the impacts of climate change on human and nonhuman life on Earth. More specifically, the handbook examines the scientific accounts of climate change as well as its causes. It explores the tools offered by social sciences and humanities to (...) study the societal premises and impacts of climate change as well as delving deeper into the ethical and political issues connected with and resulting from climate change. By doing so, it puts it all in an ecological and historical context. In addition, the book offers solutions to some important philosophical puzzles and problems, and indicates paths of interaction between philosophy and other disciplines. The discussion about climate change and the mitigation/adaptation policies spans many areas and levels – from abstract science and philosophy to current on-the-ground politics. However, climate change is also a great a philosophical puzzle. Indeed, its existential and practical relevance can be thought to largely derive from the philosophical complications it engenders. Climate change is applied philosophy par excellence. Preventing dangerous anthropogenic climate change needs very good philosophy applied to concrete and specific practical issues. Climate change is an area where scholars from very different provenances should cooperate on equal terms, having in view a common, and really important, purpose – contribute to preventing great burdens and even the extinction of humankind and the destruction of hospitable and valuable non-human nature. In Heidegger’s thought, it is possible to recognize an accurate reflection about the pain that afflicts modern man, as well as a particular indication for its cure. In pain, man experiences his being destined to metaphysics like something incurable, which requires to think the topology of the gift of being. Pain and convalescence will be exposed in that topology, under the light of The Turn [die Kehre], The Event [Ereignis] and the line between Overcoming [Überwindung] and Twisting [Verwindung] of Metaphysics, (...) in order to recognize that, in Heidegger’s reflection, it is in pain “itself” where the cure of the incurable can be possible: the passion of human finitude, the experience of the giving of being and the care of nothingness. Before overcoming [überwunden] the Metaphysics, with its intention of appropriate the being, Metaphsyisics must be reestablished [verwunden] in its inappropriate truth. (shrink)

O positivismo jurídico é predominantemente ensinado e aplicado há décadas por profissionais da área jurídica brasileira, geralmente com referência à construção teórica de Hans Kelsen (1881-1973), deixando à margem muitos outros estudos que oferecem importantes formulações e conceitos para a compreensão do Direito contemporâneo. Este artigo se junta a algumas poucas pesquisas sobre outros referenciais teóricos acerca do positivismo jurídico, analisando a regra de reconhecimento no pensamento teórico de Herbert Hart (1907-1992), apresentando-a como incremento e superação da teoria imperativista de (...) John Austin (1790-1859). A partir de pesquisa bibliográfica, mostramos que, em Hart, a regra de reconhecimento (modalidade de regra secundária) apresenta-se indispensável para a certeza necessária ao Direito, bem como para aferir a validade do sistema jurídico. Während der größte Teil der Bevölkerung die kieferorthopädische Therapie, also die Veränderung der Zahn- bzw. Kieferstellung, als eine Behandlung betrachtet, die vor allem auf eine Verbesserung des Erscheinungsbildes zielt, sehen der kieferorthopädische und zahnärztliche Berufsstand sowie auch private und öffentliche Kostenträger in bestimmten Abweichungen von Zahn- oder Kieferstellungen eine Gefährdung der oralen Gesundheit und der Funktionsfähigkeit des Gebisses. Letztere Auffassung bestimmt das ärztliche Handeln in der Kieferorthopädie und begründet auch die Übernahme zumindest bestimmter Leistungen durch die gesetzlichen Krankenkassen. Anhand aktueller (...) wissenschaftlicher Erkenntnisse lassen sich jedoch in vielen Fällen keine (akuten oder potentiellen) gesundheitlichen oder essentiellen funktionellen Beeinträchtigungen und Risiken abweichender Zahnstellungen nachweisen. Ziel dieses Aufsatzes ist es, diesem Widerspruch nachzugehen. Im Folgenden werden wir aufzeigen, welche Faktoren die Anbieter kieferorthopädischer Leistungen beeinflussen, welches die entscheidenden Gründe und Grundlagen für die Behandlung sind und an welchen Kriterien sich die Leistungsübernahme durch die Krankenkassen orientiert. Dabei wird deutlich werden, dass die formalen Kriterien von Behandlung und Kostenübernahme, die tatsächliche Behandlungs- und Kostenerstattungspraxis, die Erwartungen derjenigen, die Behandlungsleistungen in Anspruch nehmen und der aktuelle Stand der Forschung zu erwartbaren Funktionsbeeinträchtigungen durch Zahnstellungsvariationen nicht zwanglos zu vereinbaren sind. Erforderlich erscheint ein interdisziplinärer normativer Diskurs über die Frage, wie die diagnostizierten Spannungen aufzulösen wären. Als Anregung für einen solchen Diskurs werden wir im Ausblick alternative Lösungsstrategien vorstellen. (shrink)

Direct realism with respect to perceptual experiences has two facets, an epistemological one and a metaphysical one. From the epistemological point of view it involves the claim that perceptual experiences provide immediate justification. From the metaphysical point of view it involves the claim that in perceptual experience we enter into direct contact with items in the external world. In a more radical formulation, often associated with naive realism, the metaphysical conception of direct realism involves the idea that perceptual experiences depend (...) on the items in the external world they are related to. This paper describes a simple account that makes room for immediate justification provided by perceptual experience. The simple account establishes an explanatory relation between the justificatory role of a perceptual experience and the fact that such an experience provides a reason for a belief. The account is evaluated in the light of some objections. Different ways to react to those objections are discussed. It will appear that in order to preserve the explanatory relation established by the simple account, one has to accept naive realism. By breaking the connection between reason and justification, on the other side, one jeopardizes the possibility for perceptual experience to deliver immediate justification. (shrink)

rentano’s theory of inner perception, evidence and truth upsets some widespread assumptions in contemporary philosophy. It rests on an unusual notion of inner perception and on a nominal theory of judgement; it attributes a central role to evidence in epistemology and treats mental states as being intrinsically true. The present contribution aims first at presenting and elucidating some of Brentano’s views on these matters. In some crucial points Brentano’s position will be modified and hopefully en- hanced in a way that (...) is compatible with the overall picture.1 Considerable space will be devoted to the examination of some of the most important objections that have been or might be raised against the position presented on Brentano’s behalf. If by far not invulnerable, the position un- der scrutiny should hopefully appear more challenging than what it is often taken to be. (shrink)

In his article on « Vampires », in the Dictionnaire philosophique, Voltaire both evokes the phenomenon of the so-called « vampire plague » which hit Central Europe during the 1730s and recalls the controversial interpretations of this phenomenon in France and abroad. He takes advantage of the occasion to renew his anti-religious polemic, with a caustic irony that doesn’t spare even a sincere Voltairian like Jean Baptiste Boyer d’Argens, who had offered a penetrating analysis of this phenomenon in his Lettres (...) Juives. In his text, Voltaire chooses satire rather than an inquiry into causes of the phenomenon, revealing a superficial anthropological approach as well as the limits of an argument conceived as pure ideology. "Erscheinen und Verschwinden sind als Auf und Abtreten physische und symbolische Operationen, die sich auf die den Schauplatz abscheidend konstituierenden Grenze zwischen on-stage und backstage beziehen, aus dem das Geschehen auf der Bühne sich speist. Auftreten ist derart als ein riskanter und instabiler Vorgang zwischen Erscheinen und Verschwinden zu kennzeichnen. Am Beispiel zeitgenössischer Auseinandersetzungen mit den Bedingungen des Theaters, die die Bühne als Gefüge diverser Darstellungs-Flächen und -Räume nutzen, bekommt die Verwiesenheit der theatralen Präsentation auf das Anderswo einen spezifischen Witz (...) für das Verschwinden: was hier ›verschwindet‹ ist irgendwo anders. As entrances and exits, appearance and disappearance are physical and symbolic operations, which refer to the border between onstage and backstage that constitutes the scene and with it the action on stage. To make an entrance is thus a risky and unstable operation between appearance and disappearance. Using the example of contemporary explorations of the conditions of theater that use the stage as a structure of various presentation areas and -spaces, the dependence of the theatrical presentation on an Elsewhere produces a specific pun on disappearance: that which ›disappears‹ here is somewhere else.".
